1. Definitions

1.5 Agreement means the contract between the Company and the Customer for the provision of Services, incorporating these Terms and Conditions and any written or verbal confirmation of a booking.

2. Scope of Services

2.1 The Company provides rubbish removal and waste collection services for domestic, commercial, and other premises. This may include house clearances, garden waste removal, office clearances, and general waste clearance.

2.2 The specific Services to be provided, including the type and estimated volume of Waste, will be agreed with the Customer at the time of booking, based on the information supplied by the Customer.

2.3 The Company reserves the right to refuse to remove any Waste that is not as described at the time of booking, is unsafe to handle, or is prohibited under applicable waste regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email, or other method offered by the Company from time to time.

3.2 When making a booking, the Customer must provide accurate and complete information, including but not limited to:

(a) The address where the Services are to be carried out.

(b) Access details, parking availability, and any restrictions.

(c) The nature, approximate quantity, and type of Waste to be collected.

(d) Any items that may be heavy, bulky, hazardous, or otherwise difficult to remove.

3.3 The Company will provide an estimated price based on the information supplied. This is an estimate only and may be adjusted if, on arrival, the Waste differs in type or volume, or if access and loading conditions are substantially different from those described by the Customer.

3.4 A booking is only confirmed when the Company accepts the booking request and provides confirmation, which may be verbal or in writing.

4. Access and Customer Responsibilities

4.1 The Customer is responsible for ensuring that the Company has safe and reasonable access to the premises for the duration of the Services. This includes provision of necessary access codes, keys, or permissions where applicable.

4.2 The Customer must ensure that the Waste to be removed is clearly identified and separated from items that are to be retained. The Company accepts no liability for the removal of items that were not clearly marked or identified as excluded from the clearance.

4.3 The Customer must ensure that the Waste is not contaminated with hazardous substances, unless previously disclosed and agreed with the Company.

4.4 If the Company is unable to carry out the Services due to lack of access, unsafe conditions, or incorrect information provided by the Customer, the Company reserves the right to charge a call-out or wasted journey fee.

5. Pricing, Estimates and Additional Charges

5.1 All prices are quoted in pounds sterling and are exclusive of any applicable taxes unless otherwise stated.

5.2 Estimates are provided based on the information given by the Customer prior to the visit. The final price may change if:

(a) The volume or type of Waste is different from the description provided.

(b) Additional labour, time, or equipment is required to complete the Services safely.

(c) There are delays or additional expenses caused by access restrictions or circumstances beyond the Company’s control.

5.3 Any revised price will be discussed with the Customer on site before the Services are carried out. If the Customer does not agree to the revised price, the Company reserves the right to cancel the Service and may charge a reasonable call-out fee.

6. Payment Terms

6.1 Payment is due on completion of the Services, unless otherwise agreed in advance in writing.

6.2 The Company accepts various payment methods as communicated to the Customer at the time of booking, which may include cash, card payment, or bank transfer.

6.3 For commercial Customers or account holders, payment terms may be agreed separately. Where credit terms are agreed, invoices must be paid within the period stated on the invoice.

6.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate applicable in the United Kingdom from the due date until the date of payment in full.

7. Cancellations and Changes

7.1 The Customer may cancel or reschedule a booking by contacting the Company.

7.2 If the Customer cancels a booking more than 24 hours before the scheduled time, no cancellation charge will normally apply, unless the Company has incurred specific costs relating to that booking.

7.3 If the Customer cancels a booking less than 24 hours before the scheduled arrival time, the Company reserves the right to charge a cancellation fee to cover administration, allocation of resources, and lost business.

7.4 If the Customer is not present at the agreed time and place, or fails to provide access, the Company may treat the booking as cancelled and may charge a wasted journey or cancellation fee.

7.5 The Company may cancel or reschedule a booking due to circumstances beyond its control, including but not limited to severe weather, vehicle breakdown, or staff illness. In such cases, the Company will inform the Customer as soon as reasonably possible and arrange a new appointment. The Company shall not be liable for any costs or losses arising from such cancellation or rescheduling.

8. Waste Types and Prohibited Items

8.1 The Company operates in accordance with applicable UK waste management and environmental regulations. Certain types of Waste are subject to special handling requirements or may be prohibited.

8.2 The Customer must inform the Company in advance if any of the Waste includes:

(a) Hazardous substances such as chemicals, asbestos, solvents, oils, paints, or clinical waste.

(b) Gas cylinders, fuel containers, or pressurised vessels.

(c) Electrical equipment requiring specialist disposal.

(d) Any other items that may be considered dangerous, explosive, toxic, or otherwise regulated.

8.3 The Company reserves the right to refuse to remove any item that is deemed unsafe, illegal, or not in compliance with waste regulations.

8.4 If prohibited or hazardous Waste is discovered during the Service that was not disclosed in advance, the Company may cancel or suspend the Service and charge for any work already undertaken and any associated costs.

9. Duty of Care and Disposal

9.1 The Company will handle, transport, and dispose of Waste in accordance with applicable UK laws and regulations and will take all reasonable steps to ensure that Waste is taken to licensed facilities.

9.2 The Customer acknowledges that, under UK waste regulations, they retain a duty of care to ensure that Waste is transferred to an authorised carrier. By using the Company’s Services, the Customer agrees that the Company is authorised to act as a carrier and to dispose of the Waste appropriately.

9.3 The Company may issue waste transfer notes or other documentation where required by law or upon reasonable request by the Customer, subject to any applicable administrative charges.

10. Customer Warranties

10.1 The Customer warrants that:

(a) They are the owner of the Waste or have full authority from the owner to arrange its removal.

(b) The Waste does not include any items that are stolen, unlawfully obtained, or in breach of any third-party rights.

(c) All information provided to the Company is accurate and complete.

10.2 The Customer agrees to indemnify the Company against any claims, losses, or liabilities arising from a breach of these warranties.

11. Liability and Limitations

11.1 The Company will exercise reasonable care and skill when providing the Services. However, the Company shall not be liable for:

(a) Any pre-existing damage to property or items on the premises.

(b) Any damage caused by defects or weaknesses in the Customer’s property, including but not limited to flooring, walls, driveways, or access routes that are not reasonably apparent or disclosed.

(c) Any loss arising from delays, cancellations, or inability to perform the Services due to circumstances beyond the Company’s reasonable control.

11.2 If damage occurs that is directly caused by the Company’s negligence, the Customer must notify the Company in writing as soon as reasonably practicable and in any event within 7 days of completion of the Services. The Company’s liability will be limited to the reasonable cost of repair or replacement, subject to fair wear and tear and depreciation.

11.3 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11.4 To the fullest extent permitted by law, the Company shall not be liable for any indirect, consequential, or economic loss, including loss of profits, business, or reputation.

12. Insurance

12.1 The Company will maintain appropriate public liability and, where applicable, employer’s liability insurance in connection with the provision of the Services.

12.2 Details of insurance cover may be made available to the Customer on request.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing full details of the issue.

13.2 The Company will investigate complaints in a fair and timely manner and may request additional information or evidence from the Customer.

13.3 Where a complaint is upheld, the Company may, at its discretion, offer a remedy such as a partial refund, a re-visit, or other appropriate resolution.

14. Data Protection and Privacy

14.1 The Company will collect and process personal data provided by the Customer for the purposes of managing bookings, delivering Services, processing payments, and handling queries or complaints.

14.2 The Company will take reasonable steps to safeguard personal data and will not sell or rent personal information to third parties. Data may be shared with third-party providers where necessary to deliver the Services or comply with legal obligations.

15. Termination

15.1 Either party may terminate the Agreement immediately if the other party commits a material breach of these Terms and Conditions and, where the breach is capable of remedy, fails to remedy it within a reasonable time after receiving notice.

15.2 Termination shall not affect any rights, remedies, obligations, or liabilities that have accrued up to the date of termination.

16. Changes to Terms and Conditions

16.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the updated Terms and Conditions are published or communicated to the Customer.

16.2 It is the Customer’s responsibility to review the Terms and Conditions before making a new booking.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services.

18. General Provisions

18.1 If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

18.2 No failure or delay by the Company in exercising any right or remedy shall operate as a waiver of that or any other right or remedy.

18.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations at any time, provided that this does not reduce the level of service provided to the Customer.

18.4 These Terms and Conditions, together with any written confirmation of booking, constitute the entire Agreement between the parties in relation to the Services and supersede any prior discussions, correspondence, or understandings.
